Allahabad High Court rules UP Madarsa Education Act 2004 unconstitutional

In a significant legal development, the Allahabad High Court delivered a landmark verdict on Friday, declaring the Uttar Pradesh Board of Madarsa Education Act, 2004, as “unconstitutional.” The ruling, which came in response to a writ petition filed by Anshuman Singh Rathore, marks a pivotal moment in the legal discourse surrounding madrasa education in the state.

Rathore challenged the constitutionality of the UP Madarsa Board and raised objections to the management of madrasas by the Minority Welfare department, both at the Union of India and state government levels. The division bench comprising Justice Vivek Chaudhary and Justice Subhash Vidyarthi of the Lucknow branch of the court found the law to be ultra vires and in violation of secular principles.

Consequently, the court directed the state government to devise suitable measures to integrate current madrasa students into the formal schooling system. This decision underscores the judiciary’s commitment to upholding constitutional values and ensuring equitable access to education for all.
