Delhi: HC permits student to take Class 12 board exam pending CBSE officer’s approval

The Delhi High Court granted permission on Wednesday for a student to participate in the class 12th board examination scheduled for Thursday. This allowance is contingent upon the satisfaction of the regional officer regarding the rectification of deficiencies pointed out by the CBSE in the student’s application form.

The student’s application form faced cancellation by the Central Board of Secondary Education (CBSE) due to the non-submission of a domicile certificate, as outlined in the petition. Justice C Hari Shankar stated that the petitioner is eligible to take the class XII CBSE board examination, provided she satisfies the Regional Officer, Delhi East Region (ROD), regarding the rectification of deficiencies in her application form mentioned in the CBSE’s email dated January 15, 2024.

The court directed the petitioner to approach the ROD promptly so that necessary steps can be taken to ensure her participation in the examination on the following day. The CBSE’s counsel confirmed that the ROD would be informed about the court’s decision, and the ROD was urged to act upon a copy of the order without waiting for the signed judgment to be made available.

Represented by advocates Shahil Rao and Sahil Mongia, the petitioner contested the CBSE’s decision to cancel her candidature on February 15, 2024, due to the non-submission of the domicile certificate. The plea emphasized that the petitioner possesses a valid domicile certificate issued by the competent authority on September 23, 2023. The cancellation of her application, the plea argued, would result in irreparable damage, causing her to lose a year, despite having submitted the necessary documents at the time of application.
