SC: No quality education if student penalized for religion in UP slapping case

The Supreme Court has strongly criticized the Uttar Pradesh government for its inadequate investigation into an alleged incident in Muzaffarnagar. In this incident, a Muslim student was reportedly slapped by his classmates under the direction of his teacher.

The Court emphasized that quality education should not discriminate against students based on their religion. It expressed deep concern over the incident and directed the UP government to appoint a senior IPS officer within a week to conduct a thorough investigation.

The Court also called for professional counseling for the victim and the students involved. It noted that the delay in registering the FIR was problematic and highlighted the importance of sensitive education. The Court further mentioned the violation of the Right to Education Act and the necessity for the state to ensure quality education for all students.

It rejected claims that the petitioner’s status as Mahatma Gandhi’s great-grandson was relevant and suggested that it could treat the case as a suo motu proceeding due to allegations of state inaction and fundamental rights violations. The Court also involved the secretary of the UP Education Department in the case and requested a report on student counseling and improved educational facilities for the victim.

The case will be reviewed again on October 30, and the Court sought detailed guidelines from the National Commission for Protection of Child Rights regarding physical punishment of students.
